To complement theoretically driven work on argument, we present a datadriven description of published, written argument. We analyze political or philosophical treatises, articles in scholarly journals, and U.S. Supreme Court decisions. The description has emerged out of an inductive and a posteriori process based in grounded theory. The result is a suite of thirty-eight features that begins with conditions antecedent to writing and continues through to the consequences for the reader. We relate observational data to theories and practices from the (...) fields of rhetoric and applied linguistics, including pragmatics, to explain how the features work together as social and communicative acts in which the writer produces a text in order to affect or change the beliefs or actions of the reader. For our purposes, the whole text is the argument and is not reduced to its propositional content; it is a unified communicative act. In our description of argument, the writer, reader, and text are central categories. We describe these categories and their features using examples from a variety of types of written argument. Expanding the Palace of Torah offers a broad philosophical overview of the challenges the women’s revolution poses to Orthodox Judaism, as well as Orthodox Judaism’s response to those challenges. Writing as an insider—herself an Orthodox Jew—Tamar Ross confronts the radical feminist critique of Judaism as a religion deeply entrenched in patriarchy. Surprisingly, very little work has been done in this area, beyond exploring the leeway for ad hoc solutions to practical problems as they arise on the halakhic plane. This paper critically evaluates Foucault’s relation to Bachelard and Canguilhem. It reconsiders the relevance of the concept of “influence” for treating this relation in order to register the more sceptical position Foucault adopts towards knowledge practices than either of these figures from twentieth-century French epistemology.

Corporate social responsibility (CSR) has repeatedly been described as an “essentially contested concept,” which means that its signification is subject to continuous struggle. We argue that the “CSR institution” (CSRI; i.e., the set of standards and rules regulating corporate conduct under the banner of CSR) is legitimized by narratives which “decontest” the underlying concept of CSR in a manner that safeguards the CSRI from calls for alternative institutional arrangements. Examining several such narratives from a structuralist perspective, we find them to (...) be permeated with six recurrent ambiguities that we show to be reflective of three deep-set taboos: the taboo of the noncongruency between corporate profit objectives and societal needs, the taboo of multinational firms’ continued contribution to the emergence of global socioenvironmental issues, and the taboo of the CSRI’s moderate results in solving these problems. We contend that the perpetuation of these taboos contributes to inhibiting substantial change in the way of doing business, and we sketch out possibilities for initiating a “recontestation” of CSR’s meaning. Argues that the central cognitive component of ethical virtue for Aristotle is awareness of the value of particulars.

“Trust” is not usually considered a Hobbesian concept, which is odd since it is central to the definition of a covenant. The key to understanding Hobbes’s concept of trust is to be found in his account of conquest— “sovereignty by acquisition”—which is a heavily revised adaptation of the Roman justification of slavery. Hobbes introduces a distinction between servants, who are trusted with liberty, and imprisoned slaves. The servant/master relationship involves mutual trust, an ongoing exchange of benefits (protection for service and (...) obedience), and performance monitoring. In contrast to Quentin Skinner’s and Philip Pettit’s shared concentration on the contrast between slavery and freedom, I argue that the salient analogy is between servants and subjects.The trust relationship between subjects and the sovereign involves defined roles, limited absolutism, and accountability in the early-modern form of licensing subjects to switch political allegiance should a regime fail. Problematic substance use (PSU) among nurses has wide‐ranging adverse implications. A critical integrative literature review was conducted with an emphasis on building knowledge regarding the influence of structural factors within nurses' professional environments on nurses with PSU. Five thematic categories emerged: (i) access, (ii) stress, and (iii) attitudes as contributory factors, (iv) treatment policies for nurses with PSU, and (v) the culture of the nursing profession. Conclusions were that an overemphasis on individual culpability and failing predominates in the literature and (...) that crucial knowledge gaps exist regarding the influence of structural factors on driving and shaping nurses' substance use. The attention of philosophers. linguists and literary theorists has been converging on the diverse and intriguing phenomena of analogy of meaning:the different though related meanings of the same word, running from simple equivocation to paronymy, metaphor and figurative language. So far, however, their attempts at explanation have been piecemeal and inconclusive and no new and comprehensive theory of analogy has emerged. This is what James Ross offers here. In the first full treatment of the subject since the fifteenth century, (...) he argues that analogy is a systematic and universal feature of natural languages, with identifiable and law-like characteristics which explain how the meanings of words in a sentence are interdependent. Skow argues that the best metaphysic of objective becoming is the moving spotlight theory. I agree, but I think the best version of the moving spotlight theory is not amongst the theories Skow describes. I look at Skow's moving spotlight theories that invoke an extra dimension of supertime, or new primitive supertense operators, or that make presentness a fundamentally relational phenomenon, and I raise some problems for these views. I argue that the moving spotlighter should take presentness to be an (...) absolute phenomenon that changes in time. This has consequences for what it means to say the past is real. (shrink)

ABSTRACTThe conclusion of the Truth and Reconciliation Commission launched a new chapter in Indigenous-state relationships in Canada. Despite many resulting ‘reconciliation initiatives’, there remains considerable discussion as to what form reconciliation should take and for what end. Reconciliation processes must involve Indigenous peoples from the outset and should be founded on Indigenous intellectual and legal traditions. Indigenous peoples’ conceptions of reconciliation differ markedly from state-sponsored views, particularly the view that reconciliation must be achieved among all beings of Creation, including all (...) living things and entities that broader society does not consider to be alive. Indigenous concepts of reconciliation extend discussions beyond human dimensions to encompass reconciliation with the natural world as a path forward to achieve justice. As such, reconciliation must also include discussion of Indigenous environmental justice, as both Indigenous and non-Indigenous peoples need to heal their damaged relationships with each other and to the land. The Anishinaabe concept of Mino-bimaatisiwin the ‘good life’, or ‘living well’) offers guidance for ensuring that balanced relationships among all beings of Creation are maintained. Concepts such as these could provide significant guidance as we work towards achieving a more sustainable and just society through reconciliation efforts. (shrink)

I provide further elaboration of the moving spotlight view, and why I think there is real change in important features of things on this metaphysic. I explain further what I think is required for there to be genuine temporal passage, and why there is such a thing according to (...) the moving spotlight view. Aristotle, pundits often say, has a 'nous'-body problem. The psychophysical account that succeeds in the case of other psychological faculties and activities, they charge, breaks down in the case of the intellect. One formulation of this difficulty claims that the definition of the soul given in 'De Anima' II.1 is incompatible with the account of 'nous' in 'De Anima' lll and elsewhere in the corpus. Indeed there are four psychological concepts that raise the 'nous'-body problem: the faculty for thought as (...) described in 'De Anima' III.4, the intellection of indivisible objects of thought in 'De Anima' III.6, the active intellect of 'De Anima' III.5 and the type of thinking likened to the activity of the divine mind in _Metaphysics<D> XII.6-8 and _Nicomachean Ethics<D> X.6-8. I consider each in turn and argue that Aristotle is on firmer ground here than is often believed. (shrink)

In the history of liberal theories of property, the predominant model deduces a right to highly unequal amounts of property from a premise that the person is primarily independent and self‐determined. But modem social theory, communitarianism and critical legal theory have generated strong support for an alternative premise of social self‐determination of the person. These theories have not, however, adequately explored the logical implications of social personality for the justifiable degree of equality of income under property right. This study reasons (...) a right to some significant equalization of income from a premise that the individual is socially self‐determined. The supporting argument develops a different concept of social personality than found in prevailing social and communitarian theories. With regard to property, it is particularly important to conceptualize the formation of the individual by and within the system of economic relations. The personological premises are also developed differently from Marx's analysis, which overemphasizes the production side of the economy. The present analysis examines the individual in the consumption side as well. But in contrast to the subjective‐individualist conception of the consumer in neoclassical economic theory, we will utilize a conception of socially self‐determined consumer wants and self‐seeking. This social‐personological premise proves to have strong egalitarian implications for the distribution of income under property rights. (shrink)

A conception of the person as a subjective being plays a crucial, though frequently overlooked, role in the justification of unequal property in liberal theories. Unger's ascription of individualism to general liberal legal theory can be concretely defended with respect to liberal theories of property. Identifying a common fundamental structure calls in question the conventional view that the liberal legal theories rest on an ensemble of different moral foundations. So important is subjective personality to the moral basis for highly unequal (...) property that such property looks to be morally untenable if this concept of the person is invalid. The analysis points to social theory of personality as a major direction for research into an alternative theory of egalitarian property right. (shrink)

“Ignorance” is receiving an increased amount of philosophical attention. The study of it even has its own name, “agnotology.” Some ignorance remains simply a case of not having enough information, but increasingly philosophers are recognizing a whole other type of ignorance, one that is socially constructed and often actively promoted. In the first section of this paper I examine perhaps the best known type of socially constructed ignorance, “white ignorance.” White ignorance reflects a lack of genuine understanding of the social (...) realities of others and it creates injustice. In the second section of the paper, I consider what it means to “genuinely understand,” arguing that when it comes to issues of justice those with epistemic power have a moral obligation to at least attempt to understand others’ social realities. The primary problem we face when educating for social justice involves making problems and issues ‘real’ in ways that enable deep comprehension of the nature of injustice, the effects of systemic and dynamic causes, and the interaction of structures and policies on the lives of individuals. To address this problem, I examine work from behavioral economics and moral psychology as theoretical resources. I argue that we can glean insights from the notions of behavioral nudges and virtue labeling and propose a (...) new account of nudges, which I call experiential nudges. Experiential nudges provide an important mechanism in educating for social justice, in particular, and can be extended within moral education more broadly. (shrink)

The problem with remembering Auschwitz is that the neoliberal paradigm of economic utility, demotic happiness, and programmed consumption has tended to erase its facticity from public consciousness. Technoscientific capitalism functions as a regime of amnesic performance that prevents a ‘working through’ of the Nazi genocide. I argue that Agamben’s work on the implicit violence of the biopolitical paradigm gives a crucial insight into the fate of humanity in the time of global capitalism. However, I contend that the idea of testimony (...) he presents in Remnants of Auschwitz recapitulates a Heideggerian ontology of experience that is enacted outside of the technological dynamics of trauma and memory. I employ Stiegler’s concept of epiphylogenetic memory, first, to explore the economy of fascisms that has emerged within the networks of global capitalism and, second, to examine the material affects through which Auschwitz returns to the scene of this economy. ABSTRACT Although environmental and eco-centric efforts have been made in education, the sphere of influence and cogency of these efforts is limited by their anthropocentric framing of the environment. In order to subvert anthropocentric ideals, it is necessary to reposition humans in relation to other living and non-living forms. This study examines the anthropocentric tendencies perpetuated in environmental education efforts. The impetus of this work is to locate specific moments wherein human dominion is invoked within educational efforts that purportedly champion (...) environmentalism. I analyze the nature-based learning movement in particular, and illuminate these anthropocentric tendencies using critical discourse analysis. I take up variations of thematic, structural, and semiotic analyses in order to reveal how the environment is framed within a nature-based learning professional development webinar. This research poses implications for environmental educators broadly, nature-based learning instructors specifically, and researchers of posthumanist education as well. (shrink)
